A Pulaski County couple has filed a federal lawsuit charging that the under-40 policy for adoption from the Arkansas Department of Human Services is unconstitutional. After two months of fostering a newborn baby who was abandoned by her biological mother, the 53-year-old foster mother and her 44-year-old husband discovered they could not adopt the now 4-month-old girl because of their age. The policy has been in place at least 30 years, and specifies that only people ages 21-40 may adopt infants who are in the state’s custody. An infant is considered a child younger than 1 year old.

Is Arkansas's policy of barring adoption of infants by people over 40 a good policy?
